Members with discipline complaints urged to call ATA

Discipline complaints happen, but when a notice from the Alberta Teaching Profession Commission (ATPC) arrives, the first few weeks can shape the entire file. That’s why the ATA urges members to contact Regulatory Affairs immediately: the first 30 days can make all the difference. 

Under Alberta’s Education Act, the commissioner has 30 days to conduct preliminary inquiries once a complaint is referred to the ATPC. This is a short window where the complaint is assessed and keys decisions about next steps are made. While the commissioner will speak with the complainant, the teacher being investigated is rarely contacted at this stage, meaning they may not be meaningfully involved in the preliminary inquiries unless they act quickly.

This early stage is critical because if a complaint is referred to a full investigation, the process can become lengthy with no fixed timelines. The ATA has seen cases where complaints proceeded without the teacher’s perspective, leading to investigations that stretch on for years.

Often, the initial work makes the difference between a file that is resolved following the preliminary inquiry and a file that escalates into a prolonged investigation that creates uncertainty both professionally and personally.
